Flezcal Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Flezcal ("the app"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.

2. Description of Service

Flezcal is a community-driven mobile application that helps users discover restaurants, bars, and stores that serve specific foods and drinks, including mezcal, flan, handmade tortillas, and other items. Users can add spots, leave reviews, verify listings, and contribute to the community guide.

3. User Accounts

To contribute content (add spots, write reviews, vote on verifications), you must create an account using Sign in with Apple or email/password authentication. You are responsible for maintaining the security of your account credentials.

4. User-Generated Content

By submitting content to Flezcal (including spot listings, reviews, photos, and verification votes), you:

• Grant Flezcal a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the app
• Represent that you have the right to submit such content
• Agree not to submit content that is false, misleading, defamatory, obscene, or otherwise objectionable

5. Acceptable Use

You agree not to:

• Submit false or misleading information about businesses
• Harass, abuse, or threaten other users
• Attempt to manipulate ratings or verification votes
• Use the app for any unlawful purpose
• Reverse engineer, decompile, or disassemble the app
• Use automated tools to scrape or collect data from the app

6. Content Moderation

We reserve the right to remove any content that violates these terms or that we determine to be inappropriate. Spots that receive multiple reports may be hidden from public view. We may suspend or terminate accounts that repeatedly violate these terms.

7. Owner Verified Listings

Business owners may request verification of their spot listings. Owner Verified status is granted at our discretion and may be revoked at any time. Verified owners may update their spot information, including brands, details, and reservation links.

8. Disclaimer of Warranties

Flezcal is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or reliability of any user-submitted content, including business listings, reviews, and verification votes. Always verify business information independently before visiting.

9. Limitation of Liability

To the maximum extent permitted by law, Duxhenge Consulting LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app.

10. Age Requirement

You must be at least 21 years old to use Flezcal, as the app includes content related to alcoholic beverages (mezcal and other spirits).

11. Changes to Terms

We may update these Terms of Service at any time. Continued use of the app after changes constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.
